How does the UK Scale-Up Visa work in 2026?
Who it's for
High-skilled workers (RQF Level 6, graduate-level) wanting flexibility — especially those who want to work at scale-ups but worry about being tied to one employer. Also useful for senior international hires at UK scale-ups who don't want long-term sponsorship constraints.
Eligibility requirements
1) Job offer from a scale-up sponsor (≥20% turnover or staff growth over 3 years, >10 employees at start of period). 2) Role at RQF Level 6 (graduate-level). 3) Salary at higher of (a) £36,300; (b) going rate for occupation (SOC 2020). 4) English language B1. 5) Initial 6-month sponsorship; after 6 months, no sponsorship required. 6) Maintenance funds £1,270 (waived if sponsor certifies).
Application process
1) Receive offer + CoS from scale-up sponsor. 2) Apply online at gov.uk within 3 months of CoS. 3) Pay application fee (£822) + IHS (£1,035/year, £2,070 for 2-year visa). 4) Biometrics. 5) Decision in ~3 weeks (overseas) or 8 weeks (UK switch). 6) On approval: 2-year visa with 6-month sponsorship requirement. 7) After 6 months: free to switch employers, work multiple roles, or self-employ. 8) Can extend for further 3 years (totaling 5 years) and lead to settlement.
Costs and timings
Application fee: £822. IHS: £2,070 (2-year). Total: ~£2,900. Sponsor pays no skills charge (unlike Skilled Worker). Decision: 3 weeks (overseas), 8 weeks (UK). Path to settlement: 5 years total (initial 2 + extension 3). Faster settlement than some alternative routes.
Common reasons for refusal
1) Sponsor doesn't qualify as scale-up (insufficient growth or fewer than 10 employees). 2) Salary below threshold. 3) Role below RQF Level 6. 4) English language test issues. 5) Sponsor licence revoked between CoS and application. 6) Not applying within 3 months of CoS.
Worked example
Yui from Japan was offered a head-of-marketing role at a UK fintech scale-up (50→180 employees over 3 years). The role paid £75,000 (above both £36,300 and the going rate for marketing managers). After 6 months at the company, she could legally work elsewhere — but she stayed because she enjoyed the role. After 2 years she extended for 3 more years and obtained settlement. Total time to settlement: 5 years; total cost much lower than Global Talent + endorsement route.
Recruiter pro tip
The Scale-Up Visa's flexibility-after-6-months is its hidden value. If you're considering UK roles but worry about being tied to one sponsor, this route gives you sponsor-tied employment for 6 months only — then total flexibility for the remaining 18 months. Useful for senior hires at scale-ups who might want to angel-invest, advise, or pivot. The scale-up sponsor list at gov.uk is publicly available and updated regularly.
Important: UK immigration rules and salary thresholds change frequently. Always verify current rates and rules at gov.uk before applying. For complex cases, consult a qualified UK immigration solicitor (regulated by the Solicitors Regulation Authority or OISC). This guide is for general information only, not legal advice.
