What if my UK job offer is rescinded?
Get it in writing. The withdrawal email or letter is the legal record. Specifically, you want the cited reason — 'failed reference check', 'right-to-work issue', 'change of business circumstances', etc.
Conditional vs unconditional. Conditional offers can be rescinded if the conditions fail (references, right-to-work, DBS, financial checks). Unconditional offers — once accepted in writing — are harder to rescind.
Mitigation steps. If you've already resigned your previous role, you may have a claim for breach of contract. UK courts can award damages for the offer-acceptance-resignation chain even if the offer was technically withdrawn before the start date.
Take Acas advice immediately. Free helpline: 0300 123 1100. They can help assess whether you have grounds for tribunal claim or breach of contract.
Negotiate the withdrawal. Some UK employers, when asked, offer a small ex-gratia payment (1-3 months' salary) to soften the impact and reduce litigation risk. Worth asking specifically.
If the rescission feels discriminatory (timing coincides with disclosed pregnancy, disability, or characteristic), the case is much stronger. Document specifically and seek legal advice.
